Rewards Loyalty Program Terms & Conditions

The Sunny PerksTM Rewards (“SPR”) Loyalty Program was created to recognize and reward loyalty across BBM America, LLC affiliated companies. As part of the SPR Loyalty Program, members can earn SPR Rewards, as explained below. The SPR Loyalty Program is a national program offered through purchases and/or participation with programs of Original Orlando ToursSM, Big Deal PassTM, AmeriVoicesSM, CX OrlandoSM , Sunny’s OutpostTM , and Sunny’s MarketplaceSM and other BBM America, LLC owned or affiliated companies, vendors and partners in the United States. These Terms and Conditions (“Terms”) apply to your participation in the SPR Loyalty Program and not to any other website, mobile app, product, service, or program offered by SPR.

In order to participate in the SPR Loyalty Program, you must agree to these Terms.
Please read these Terms carefully, as they are a legal and binding agreement between you and SPR, that apply to your use of the enrollment and participation in the SPR Loyalty Program. If you do not agree to these Terms, do not participate in the SPR Loyalty Program.

Eligibility
In order to join the SPR Loyalty Program, you must be an individual and at least 18 years of age. Corporations, partnerships, limited liability companies, trusts, or other legal entities are not permitted to enroll. Each SPR Loyalty Program member may have only one account linked to a unique email address. Employees of BBM America, LLC, and its affiliate companies, vendors, partners, and suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to participate in the SPR Loyalty Program.

Registration and Enrollment

To enroll in the SPR Loyalty Program and begin earning SPR Loyalty Rewards, sign up through one of the participating BBM America, LLC owned or affiliated companies, vendors and partners, or go to the SPR website and follow the steps below.

  1. Go to SunnyPerks.com
  2. Click the Register link at the top of the page.
  3. Create an account by submitting your name, email address, date of birth and password.
  4. Begin earning SPR Rewards right away!

When you enroll, you agree to (1) provide accurate, current, and complete information about yourself, and (2) maintain and promptly update your information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify SPR immediately of any unauthorized use of your account information, or any other breach of security.

If any information you provide SPR is not accurate or complete, we may block you from enrolling in the program, or we may cancel your membership in the SPR Loyalty Program. Each person may only have one Loyalty Program account. If SPR finds that you have created multiple SPR Loyalty Program accounts, we may cancel all your accounts and you will forfeit any accumulated points in those accounts. Further, SPR may refuse to allow you to re-enroll in the SPR Loyalty Program in its sole discretion.

SPR will use your contact information to keep in touch with you via email, text, twitter, Facebook and/or other social media platforms as may be in use when you enroll or as may be added by us afterwards. If your contact information changes, or if you wish to change your contact information or the method by which we send you messages (e.g. start having messages sent to your mobile phone number), please log into the SPR website and update your contact information or preferences.

SPR Rewards

As benefit of being a member of the SPR Loyalty Program, you can earn and receive points that will count towards SPR redemption items. Members earn points of varying quantities for specific events within each partner program, up to a maximum of 1000 points total from all participating programs per day. Points are not awarded for purchase of gift cards on any site. SPR points accumulated under the SPR Loyalty Program are promotional and have no cash value. There are no membership fees associated with the SPR Loyalty Program.

Earning Points:

SPR Loyalty Program members will earn and receive SPR points by making qualified purchases or meeting other earning objectives at BBM America LLC owned or affiliated companies, as well with participating vendors and partners. Earning requirements and earned point values are outlined within the Sunny PerksTM Rewards website. Some SPR points are allocated as soon as earned; others earned in any month are applied to your SPR Loyalty Program account in the next month, typically by the fifth (5th) business day, depending on the company that you earned them through. You can track your points and Rewards by logging into your Rewards Account History.

Redeeming Rewards:

By accumulating specific point totals in your SPR Rewards Account, you have the ability to redeem some or all of your points to exchange them for a reward (“Reward“). Redemption totals and corresponding Rewards vary and may be changed at any time by SPR. Once you redeem points for a Reward, you the required points needed to exchange for that Reward will be deducted from your account.

Additional Rewards Program Terms:

SPR reserves the right to terminate your SPR Rewards Account and/or your participation in the Rewards Program if we determine in our sole discretion that you have violated these Terms, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. SPR may, in its sole discretion, suspend, cancel, or combine SPR Rewards Accounts that appear to be duplicative, and may refuse to allow you to re-enroll in the Rewards Program. If you are banned from working as an evaluator with CX Orlando, SPR will terminate your associated SPR Rewards Account and all accumulated points will be forfeited. SPR reserves the right to terminate an SPR Rewards Account if the account has been inactive for 24 months. Inactive means that no points have been earned. If the account is terminated, all points will be forfeited and considered expired.

SPR has the right at any time, with or without giving you prior notice, to:

  • end or cancel the SPR Loyalty Program, SPR Rewards and/or any specific Reward;
  • end or change the participating companies, vendors and partners;
  • change any Reward or other SPR Loyalty Program or Reward benefit we offer;
  • change the requirements for earning points or a particular Reward;
  • change the time you have in which to earn or redeem a particular Reward; and/or
  • change any other feature of the SPR Loyalty Program or SPR Rewards.

If SPR ends the SPR Loyalty Program or SPR Rewards, Rewards you have earned but not used will expire on the date the SPR Loyalty Program ends or SPR Rewards are no longer offered. Earned but unredeemed Rewards shall be void after such date.

SPR Rewards Accounts may not be combined.

Modifications
We may modify these Terms from time to time. When we do, we will notify you by email or in another manner. It is therefore very important that you update your account information or notify us when your email address changes. Any changes to these Terms will also be posted here. Your continued participation in the SPR Loyalty Program after any modification confirms your acceptance of the modifications.

No Warranties

THE SPR LOYALTY PROGRAM AND ANY REWARDS ARE PROVIDED ON AN “AS IS”, AND “AS AVAILABLE” BASIS, AND SPR HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, SPR DOES NOT GUARANTEE THAT THE CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitations of Liability

IN NO EVENT SHALL SPR, BBM AMERICA LLC, ITS COMPANIES,VENDORS AND/PR PARTNERS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY DAMAGES (DIRECT OR INDIRECT) WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE ARISING OUT OF OR IN CONNECTION WITH THE CONTENT, THE SPR LOYALTY PROGRAM, PROGRAM REWARDS, OR THESE TERMS, WHETHER OR NOT SPR MAY HAVE BEEN ADVISED THAT ANY SUCH DAMAGES MIGHT OR COULD OCCUR AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. THIS PROGRAM SHALL BE governed by, and construed and interpreted in accordance with, the laws of the State of Florida without regard to conflict of laws principles. Any legal proceeding of any nature brought by either party against the other to enforce any right or obligation under this Agreement or arising out of any matter pertaining to this Agreement shall be heard in either the State or Federal courts located in, or having jurisdiction in and for, Seminole County, Florida. BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.

Keeping in Touch with You

As a part of the SPR Loyalty Program, SPR will send to you informational and promotional messages to the contact information that you provide as a part of your registration, such as messages informing you of improvements we make to the Program, new Rewards you may earn, new SPR companies, vendors and/or partners participating in the SPR Loyalty Program or new Rewards earning opportunities that you may want to participate in. These communications may happen in the form of push notifications through an app, via social media and/or by email.

Electronic Communications

When you send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or possibly by posting notices in the future on an app. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication as described in these Terms.

Privacy
Please review our Privacy Policy located at https://www.sunnyperks.com/privacy-policy/, which is incorporated herein, and governs how the information you provide to SPR through the SPR Loyalty Program may be used.
